Abstract
Akıl, yüce Allah’ın, insana sunduğu en büyük nimetlerdendir. Çünkü insan, aklı sayesinde diğer canlılardan farklı ve üstün bir konuma gelmiştir. Aklın, sarhoşluk ve benzeri bir nedenle sarsılması durumunda, insan, düşünce ve irade yoksunu bir canlı haline gelir. İslâm hukukçuları, aklın dengesini bozan, onu donduran, uyuşturan, bilincin farklı derecelerde kaybedilmesine ve hatta beyin ölümüne neden olan bu maddeleri “muhaddirât” olarak tanımlamışlardır. Rabbimiz, Kur’ân’da; din, nefis, akıl, nesil ve mala zarar veren bu maddeleri, “şeytan işi pislik” olarak isimlendirmiş ve “ondan kaçının” buyurmuştur. Bundan dolayı da isim ve niteliği ne olursa olsun aklı sarsacak ve insana zarar verecek olan her tür madde; “Sarhoş eden her şey hamr’dır. Hamr’ın hepsi de haramdır” hadisi gereği de aşamalı olarak tamamen yasaklanmıştır. O halde gerek kendine, gerek başkasına bu şekilde zarar veren kimslerin, caydırıcı bir cezaya çarptırılmaları ve onların da bunu kabullenmeleri, onlar hakkında âyetin ifadesiyle:”Uygun bir ceza” olacaktır. Nasları yorumlamadaki farktan dolayı cezanın cinsi ve miktarı hususunda görüş farklılıkları olmuştur. Siyasi otorite/devlet başkanı, had cezası olarak değil de kendisine tanınan mübah sınırları dahilinde, bunu, caydırıcı olan bir tazir cezası olarak uyguladığında bu sorun giderilmiş olur.

Abstract
Mind is one of the greatest blessings that God has offered to man. Which caused the humankind to be in a more superior status than the other living things. In a situation where the mind is intoxicated by alcohol or other similar substances, a human, becomes a creature devoid of thought and will. Islamic lawyers have defined these substances that disturb the mind, freeze it, make it numb, cause loss of consciousness and even brain death to different degrees of drugs. Our Lord has mentioned in the Qur’an; These substances which harm religion, soul, consciousness, generation and property, are named as “the work of the devil” and commanded us to Therefore, regardless of its name and quality, all kinds of substances that will intoxicate the mind and harm humans; “Any substance that affects the human mind is considered a intoxicant (Khamr), Every kind of intoxicant (Khamr) is forbidden (Haram).” Because of this hadith any intoxicant substances is “Khamr” and is completely banned. In this case, those who harm themselves or others in this way must be punished with a deterrent punishment and they must accept it, as it is mentioned in verse written about them: it will be “an appropriate punishment”. There were differences between opinions regarding the type and the amount of punishment due to the differences in interpreting the words. This problem is solved when the political authority / president implements this as a deterrent punishment, within the permissible limits given to him.
