Abstract

Belirli bir kişiye ait olan ve o kişiyi belirlenebilir kılan bilgiler kişisel verilerdir. Kişisel veriler, kişiye özgüdür ve kişinin özel hayatının bir unsurudur. Kişisel verilerin, ilgili kişinin rızası veya isteği olmaksızın ele geçirilmesi, başkalarına verilmesi veya yayılması kişinin özel hayatına dair bilgilerin ifşa olması demektir. Bu da Türkiye Cumhuriyeti Anayasası’nın 20. maddesinde düzenlenen, kişinin en temel haklarından olan özel hayatın gizliliğine saldırı demektir. Çağımızın şartları da bu denli önemli olan kişisel verilerin daha hassas bir şekilde korunmasını gerektirmektedir. TCK m. 136’da düzenlenen “verileri hukuka aykırı olarak verme veya ele geçirme” suçu ile korunması amaçlanan hukuki değer de özel hayatın kişisel veriler ile ilgili olan kısmıdır. Çalışmamızda mezkûr suçu, suç inceleme metoduna uygun olarak inceleyeceğiz; suçun nitelikli hâllerine, özel görünüş şekillerine ve muhakemesine değineceğiz.

Abstract

The information which belongs to a particular person and makes this person denifable is personal data. The personal data is special to person and an element of person’s private life. Obtaining, giving or spreading of personal data without consent or will of concerned person is disclosing of information related to person’s private life. This means an assault to privacy of private life which is one of the main rights of person and regulated in the article 20 of Constitution of Republic of Turkey. Also the conditions of our era require sensitively protection of personal data which is important this much. The legal value intended to be protected by offense of unlawfully giving or obtaining of personal data regulated in article 136 of Turkish Criminal Code is personal data related part of private life. We will examine this offense in pursuance of the offense examination method and touch on qualified states, special appearance forms and judgment of this offense.
